Applicability

These Terms apply to every offer made by ComfyKurta and to every distance contract concluded between ComfyKurta and the consumer.

Before concluding a purchase, these Terms will be made available electronically.


Offer & Product Information

We describe and present our clothing products as accurately as possible.

Obvious mistakes or errors in pricing, product descriptions, or availability are not binding.

All offers are subject to availability.


Prices & VAT

All prices displayed on our website:

  • Are shown in EUR

  • Include VAT (BTW) where applicable 

  • Exclude shipping costs unless stated otherwise

Shipping costs are clearly displayed before completing the order.

We reserve the right to change prices at any time. However, the price applicable to your order is the price displayed at the time of purchase.


Conclusion of the Agreement

A purchase agreement is concluded when:

  1. You place an order through our website, and

  2. You receive an order confirmation email from us.

We may refuse or cancel an order in case of:

  • Incorrect pricing

  • Payment issues

  • Suspected fraud

  • Product unavailability

If payment has already been made, a full refund will be issued.


Right of Withdrawal (Herroepingsrecht)

In accordance with EU Directive 2011/83 and Dutch consumer law:

Consumers have the right to withdraw from the contract within 14 days without giving any reason.

The withdrawal period expires 14 days after the day the consumer receives the goods.

Return Conditions

Returned clothing must:

  • Be unworn and unused

  • Be free from stains, makeup, perfume, smoke, or odors

  • Have original tags attached

  • Be returned in original packaging

  • Be returned within 14 days

The consumer is liable for any diminished value resulting from use beyond normal inspection.

Return shipping costs are borne by the consumer unless the product is defective.


Payment

Payment must be completed before shipment.

We accept the payment methods displayed at checkout.

If payment fails, the order will not be processed.


Delivery

We will ship orders within the stated processing time.

Delivery times are indicative and not strict deadlines.

Risk of damage or loss transfers to the consumer at the moment of delivery.


Complaints Procedure

Complaints about the performance of the contract must be submitted within a reasonable time after discovery of the defect.

We aim to respond within 14 days.

If you are located within the EU, you may also use the European Commission’s Online Dispute Resolution (ODR) platform.


Liability

ComfyKurta is not liable for:

  • Indirect or consequential damages

  • Loss of profit

  • Delays beyond our control

Nothing in these Terms limits statutory consumer rights under Dutch or EU law.


Governing Law

These Terms are governed by Dutch law.

If you are a consumer residing in another EU Member State, you may also rely on mandatory provisions of your local consumer protection law.
